Don't be afraid to claim

THE myth of the ‘compensation culture’ is promoted by insurance companies and employers who want to be able to get away with cutting corners on safety, without compensating the victims or any resultant accidents.

The Government’s own research shows the number of compensation claims is falling each year, not rising, as the spin claims.

The UK awards less compensation than all other major European countries.

However, businesses and insurance companies who pay out the compensation dismiss what they call ‘minor injuries’ which include bone breaks and scars.

They continue to lobby MPs, and have persuaded many that up to half of such victims should be left without legal help; knowing they’d likely give up on a court claim without legal representation.

Many employees are scared of the possible repercussions of filing a claim against their employer.

Generally speaking, such fears are needless as all employers are expected by law to have employer’s liability insurance, which should cover them if an employee is injured in the workplace and lodges a claim.

You should also remember health and safety law places an absolute responsibility on employers to ensure they do everything possible to ensure the working environment is safe for their employees.

So, if you are injured in a workplace accident, there is every probability you will be legally entitled to compensation.

Don’t let concerns about the so-called ‘compensation culture’ deter you from making a claim if you are injured at work.

Your trade union, if you have one, Citizens’ Advice, or a solicitor, will all be able to advise you on how to make a claim.
